You can say 'Yes', but it will trigger unnecessary questions from IO. I am not sure about the consequences. If I were you, I would say NO as its not full time course and not going to change the status to F1. I beleive you should say 'YES' only if you change to F1 visa in the future.

My wife is in the same boat. We filed for H1 amendment in the first week of September and online status tells it's done on 20 November. We still have not received documents in mail from USCIS. This was in Vermont. We were told initially that it might take upto 3 months.

Can someone work in US on H1B and in India for an Inidan company and get paid in Inidan currency? If H1B restricts you from doing so I am willing to switch to EAD if that permits me from working remotely for indian company.

Just to be contrarian, I think the recent H1-B and L-1 fee increase is an opportunity. Instead of playing a victim of legislative abuse, we should come out batting with an offense. We should get businesses to lobby for us. We should get congress people educated about the unfairness. We should not say the fee is wrong, because these are after all elected officials and they will not jeopardize their election prospects by going against this measure. So we should say ok take this fee but then provide us with administrative fixes that we want.
The H1B/L1 fees is designed to hit the body shopping business model. It is nothing but a
legal/labor cost arbitrage that most indian IT service shops follow.
The fees is not the last but the beginning and more will be piled on as they will come back again in a year or so to fund more "secure the mexican border" initiatives. It is a beast that can never be satisfied. The American It companies are not impacted by the 50% rules and they care less about it. So it the resistance effort will be very minimal...like it happened this time.

I got my finger prints and Advance Payrol receipt numbers from USCIS but not I765(EAD). I called USCIS about EAD receipt nbr but they said "System not yet generated I-765 receipt nbr". My attorny and employer not responding abt EAD receipt numbers and someware I have doubt they did not fill my EAD's as they know after getting EAD i can work for other employer which is 6 months from receipt date. Is their anyway I can track whether they filled my EAD form or not?
Also please advise is thier any alternative way I can fill EAD's.

I think your first point is valid. I would do the same thing. If you are using AP, I don't think you need to go for stamping.
Your second point is some what complicated. As your H1 is expiring in April, if you renew it later in July, it might go for consular processing, which means that you won't get the I 94 with the approval notice. In that case you need to reenter uisng a valid visa.

its good to use your OPT card as long as its vaild and then move to H1, there is no time frame for stamping, its always good to go to your home country and then get it stamped,but once you start working on H1(your payrolls starts on H1) then your H1 clock starts

1) Talk to your lawyer and see if contacting your local congress person would help you.
2) Post in other forums as well such as murthy.com and immigrationportal.com.
Good luck. The whole GC process is very stressful when everything is progressing without a hitch. So, I cannot imagine how much more stressful it must be when things get screwed by BEC and/or USCIS.

Had my appointment on Sept 8 at 10am, wife was also with me for her H4 stamp. Went for fingerprinting, then went to 20th floor for interview.
This was the interesting part! The Visa officer asked where I worked, then asked me where I was from. I said Lahore, he then started asking me about situation there with respect to the floods, and whether our families were affected etc. He then said, everything looks good and told us to come back on the 10th (2 days later) to collect passports. He did not check a single document (job letter, paystubs etc.). Just asked me about Lahore and sent us on our way.
Considering I am Pakistani, I thought this should give hope to other Pakistanis applying. Btw my first name is not so rare, but last name very rare. Also work for a Fortune 100 firm.

On May 5, 2008 I got a message through my employer that they received an EAC receipt number from USCIS.While checking online we received a message
Application Type: I129, PETITION FOR A NONIMMIGRANT WORKER
Current Status: Case Rejected because of Incorrect Fee
On May 5, 2008, we determined that this I129 PETITION FOR A NONIMMIGRANT WORKER was not properly filed because you submitted incorrect fee. Therefore, we have rejected your case and returned it to you with all supporting materials, along with the fee. Please follow the instructions on the notice to submit the case with correct fee."
The online notice specifies that "Please follow the instructions on the notice to submit the case with correct fee". Unfortunately, we did not receive the notice till June 5, 2008. I called USCIS and requested them for the papers, they reassured me to have the communication sent to their Vermont office and that I have to wait for another 45 days. Today morning 26th June, 2008 my employer received a notice from USCIS saying that the H1-B petition has been rejected because it was not randomly selected for processing.
I am confused how can I get a receipt number without getting randomly selected? what can I do in this regard please help me!
