How can you use I-140 from Company A and 485 from Company B. I think you can't do it.
But I think you can use AC21 with Company B as 180 days has crossed after filing 485 and your I-140 is pending. This is very risky.
I would suggest you to consult an Attorney before taking any decision.
485 is not based on any company....

That is the problem. There is no such thing in the flcdatacenter, but in onet online, there is a

Here is the problem. So by this token, does it mean that IT Project managers either need to be classified as CIS managers or not get classified at all? This is absurd.
The attorney is not giving out any suggestions on what to do as they already filed, got a high PW and appealed which got denied.
The attorney is suggesting to refile, something I don't think is going to change the outcome.
Any suggestions?

Proves that we are not cheap labor and we are not driving the salaries down. I know citizens in my position in my company are not being paid more than me. We had waited for three months to fill a position and we have to compromise in the end because we could not get enough resumes to go through.

We did check that. What we wanted was I.T project manager, but it got classified as CIS Manager.

My clients will be in USA and they will be paying my company in India. I will be on the board of the company , and will be doing voluntary marketing and promotional work for the company while residing in USA.

I am just curious if a new employer can keep extending h1b based on previous employers I140 (and the fact that 180 days have passed since 485).

nope on an EAD, my h1 is long expired and never renewed it even with the employer that sponsored my GC. i was using EAD even with them..and with the current employer too..

As I understand, your GC application is based on your husband's I-140.
Does your husband work for a different employer or the same employer as yours?
If different, you can kick your employer's A$$ and they can't do a thing.
If same, they may be blackmailing you because your husband's GC depends on them for some time - 3 more months.
If it is the second case, why don't you just work on H1 for the next 3 months and then do whatever you want..
BTW, he can not do any damage to you or your pending GC in any way by cancelling your H1.. Doing it will put them in bad light for wasting a precious H1 visa by misrepresenting the facts..

All State is saying is that they are giving EB2-India a total of 2987 visas. They didn't care about spill over and slow consumption by ROW. They are still acting stupid but this time they are trying to show reasoning for their stupidity. If this report had a consumption of visas till date for FY10 like in a dash board, then they would have seen their own stupidity clearly.
I think you are making too much out of it. All they have said is 2987 per country. Below they do mention it flows from E1 to E2 to E3. Do you seriously think that they are going to say exactly how much the spill over is?

Thanks to everyone for the advice. Here's my situation:
Yes, Mats, it jiggles when I adjust the camera. Bracketing should help some, but my understanding of the HDR process is that you want to get a range of exposures from almost black to totally blown out. My camera will bracket through three exposures, one stop on each side of the setting. That doesn't typically get the span that is recommended for the HDR thing in Photoshop CS2, so I'm still looking at touching and adjusting the camera.
The camera is really just a point and shoot, a Minolta Z3. There are no available shutter release cables, remote controls, or other accessories for remote operation of it. However, my next camera....! ;)
Lastly, the tripod is a $30 wal-mart model. It isn't really so wobbly in the legs, but the main mast of it, where I mount the camera, rotates freely through about a 3 - 4 degree range horizontally. This is due to play in the cheap, plastic parts on it. My short term work around for that is probably to jam juicy fruit gum into the gaps or something.
All of this equipment that I bought was for me to learn the basics on, and I am doing a lot of learning these days. So, there again, my next tripod.... ;)

My experience says dont worry unless someone else comes back and say they had issues with different A#s on 140 and 485. I had applied for EAD and AP on the A# of 485 and was approved. Finally my GC has the A# on 485.
