Hello,
My wife and I both work for the same company and my PD date is 1 year behind my wifes. But she was born in Germany though she is currently an Indian citizen. Now that the ROW category has moved passed her PD's date (Nov 6th 2002), we plan to file under the ROW category using the Cross Chargability rules. Does anybody have any experience filing under this rule? We have her birth certificate (translated into English from German etc) and our lawyers will send us the list of documents i expect. So basically i am trying to find out what to expect when filing under this category. Are there any caveats, good to knows etc?
PS- I am also an Indian citizen but i will obviously piggy back on her application since my PD is not current.

I recently returned from an international trip (flew into JFK), and the only document that the CIS officer asked for was my AP. Based on what my lawyers had said, the only 'required' document is your AP, although it probably doesn't hurt to have copies of the LC, I-140, I-485 (more for peace of mind!).

Hi:
Maybe some of you can help me with my problem. I was directly hired to work in the US with two other colleagues. Our PD was April 04. We got our LCs last year. My two friends and I applied for I-140 last December 2006. (same job, same employer sponsoring us). The two got their I-140 by June and were able to receive their GC courtesy of the July fiasco.
Last May 07, I was told that I was mailed an RFE. I never received it. As you may know, you can only follow this up after a month. Three phone calls (and months) and two faxes (two months) later, still no letter. My lawyer is at his wits ends. The other day, he gets an appointment at a USCIS center near our area. He says this office has no jurisdiction over my case and that this was a long shot. An immigration officer looks at the computer system in the office and says that the systems list of RFE cases does not include my name, and perhaps there was an error. Perhaps
Has anybody heard of a similar case? My lawyer is now suggesting that I write a congressman for help. Do you think this will help?
My husband and I filed our I-485 + his EAD last July 19. Today we received acknowledgment receipts for both and a notice that we have to go thru FP next week. . Is this a positive sign , or does this mean nothing at all? I noticed that current PD for 3rd preference visas has rolled back to Aug 02. Can anyone hazard a guess as to how long we may reasonably have to wait for a GC? Or for my husbands EAD?
Thanks.

My case was filed in EB-3 category (August 2003). I completed a doctorate in 2007. I am thinking of filing in EB-1 and EB-2. Can anyone help me with links for preparing these applications and some dos and donts? Also is there any way to recapture my earlier PD (Aug 2003) for the current filing? Thanks for your help.

I am in the same situation.. send docs to Dallas lockbox.
Applied for EAD renewal and documents reached on May7th.. checks not cased yet. I think the whole lockbox is creating the delays but one they get to your application it is relatively quick.
Do let me know when your checks are cased.

I had applied for my H1B extn and got an RFE. Lawyers replied to it and its almost 7 weeks now, haven't got any reply.
Is this a usual timeframe? how long will it usually take for USCIS to take any action on the RFE's after the reply was sent with all appropriate documents?

Can anyone please tell, can the employee be trained by the employee before activation of visa i.e. 1st of October. The employer is not paying employee any wages for his training. Can his training be legal ? Is he allowed to sign any documents on behalf of the company during this training ?

Hi,
I have a question. I am on H1 and are planning to extend my H1 along with my wife H4. My question is, we both have EAD's and I never use EAD. My wife is looking for jobs on EAD. If she works on EAD, can she still able to extend H4 status?
Thanks
As long as she does not work, and she has entered the country using her H4 (as against entering using Advance Parole), she is on H4. Once she uses her EAD, she is no longer on H4. Subsequent US entries will need to be on Advance Parole.
This is my "understanding".

Hi
My H1b was approved in feb 2010 for location A.Before I could start working at location A,my company found a better client (close to home, better pay) at location B .(different state).
what should my company do or have done with regards to lca for me to work at location b.
should lca have been approved before I moved to location b or could it be filed after i started working at location b. If lca was filed after I started working, is that ok.If not, how do we correct this.
thanks

Wondering if a little something when filing my taxes will backfire on me when filing I-140/485.
I'm single/no dependents but for past 4 yrs or so when filing taxes have showed 2 dependents for child tax credit (no earned income credit applied for)....my niece/nephew. My bro had full knowledge and he had suggested as due to his status in US, he is not required to file taxes. Sis in law not working, so not filing taxes. So i used to do that....
It won't come to bite me right???? ok i am never doing this from now on but is it too late for me. Obviously on my immigation forms i will show no dependents etc as i have none...
any advice.....

USCIS is increasing fees of various applications from 23, November 10
USCIS - Fact Sheet: After Public Comment, U.S. Citizenship and Immigration Services Announces Final Rule Adjusting Fees for Immigration Benefits (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=5be73dc5cb93b210VgnVCM100000082ca60aRCR D&vgnextchannel=68439c7755cb9010VgnVCM10000045f3d6a1 RCRD)
Is there anyway we can find the fee strcutrure that was inplace in 1999, 2000. Later there was an increase around 2001 i think. Then onwards every couple of years fee has been increasing continuosly for 129, 131, 140, 485, 765 . May be more categories that might be applicable for employment based immigration.
My point is if we can present the facts in a nice manner to IV core team, may be they can come up with a plan to shed more light, potentially plan of action
