I have 2 H1B Transfer questions for clarification.
1. Can H1B Transfer be filed when H1B Extension is pending with the current employer?
Yes, a transfer could be filed while an extension is pending. This is the so-called anchor transfer. However, the transfer would be denied if the extension petition is withdrawn before the transfer is approved.
2. Do i need to have copy of I-140 approval notice for H1B Tranfer? The current employer does not share this document.
The 140 approval notice is not required unless this is a post six year transfer/extension.

1)My I 94 expires in 2 months.I don't want to extend H1 and I want to use EAD.So how can I extend my I94 if I start using EAD?
2)I finished 4yrs of stay on H1B. If I don't extend H1B now and start using EAD, if by any reason my 485 denies in future, can I switch back to my H1B and work for the remaining 2yrs on H1B?
Just start using your EAD and if you have an Advance Parole use that next time you enter the country from a trip abroad and you will get a new I-94.

Hello,
My 6 year H1 term expires on Feb-2010. I have a I-140 pending in NSC since July-2007 with no signs of movement.
Hypothetically, if my I-140 gets processed after Feb-2009 and is denied (God forbid!), then will I be able to extend my H1 visa? If so, on what basis can I do it?
I do understand that H1 can be extended only before 6 months of expiration if and only if I have a I-140 pending or approved.

TSC processing times for Feb is out.
I-485 has advanced to 18th July 07.

Any idea with whats going on with TSC Processing times, my PD is current Nov' 2003, however do not see any movement in the processing times, 485 applied on Aug 7, 007, any idea when they will publish the new processing times? Any way we can know where we are in the 485 proccess?

This may sound strange but, here is my situation. I'm currently on EAD and my I-94 expired last year after i got my EAD. Does this have any impact on my EAD renewal????:confused:

I have renewed my DL in VA while my H1B was pending last year (Oct 07) . All you need is your H1-B application receipt and they will extend it by 1 Year.

Alexey - I only have a very basic understanding of Grids in both Silverlight and Flex! With that said, the Grid control is fairly complex in both Flex and Silverlight. Porting between them might be tricky, but I've never tried so I am only guessing.
I'll pass your feedback on to some colleagues who may either have an answer or use your feedback for future Grid-related improvements :)
I'm going to play with Grid a bit inside Blend and see if I can come up with a workaround.

What is the priority date?There is an employer who filled PERM for me in October 2008 and the PERM was approved.I-140 was not filled.
The employer laid me off due to bad economy. Can I still claim October 2008 as my priority date?

You can take FP test at any location in United States. Just make sure that you go to the nearest location at the time mentioned in the notice. I had an appointment at the Oakland office but I went to the San Jose office and they let me do the FP test there. I had gone to them the previous day to confirm whether I can take FP test at their office and that's when they told me that I can go to any office in US.

My case is a bit different.
I have a 485 filed by a company for future employment.
Right now my Priority date became current for my current employer and that labor and I140 are approved.
So can we file multiple 485's with USCIS or do we need to cancel the other 485 to file new 485 with my current employer.

That is correct. If your employer is enrolled in E-verify then he needs to updated your information in that system otherwise just keep the form for record.
One correction - the employer does not update anything in E-Verify. It is a read-only system to the employers to verify the authenticity of document provided by employees.

According to a recent USCIS guidance an employer may not hire an H-1B worker prior to USCIS approving the H-1B petition unless the employee (i) is currently in H-1B status, or (ii) is the beneficiary of a timely filed H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) extension of status petition. I have a PERM filed on Nov 2006. and it is approved. Like most ppl here I also applied for I-140 & I-485 during July and got the receipts. I am looking to change companies using AC21 by next Jan but would like to keep my H1B active.
I have the following qns:
a. If I find a new employer(B) who is willing to transfer my H1B, will I get extension 3 yr extension beyond 6 yrs based on my current employer(A)'s PERM and approved I-140.
b. I know that 3 yrs extension is possible with approved I-140. Is it possible with new employer also (the one who has nt filed ur GC ? Also Is 3 yr extn possible after filing I-485 beyond 6 yrs?
