I have done quite some research on this. Bottom line is you are taking major chance in loosing it unless one of the following applies.
1) You are married to Canadian citizen.
2) Your company is Canadian (or has office in Canada who can give letter that you are direct employee of a Canadian company working abroad).
Otherwise you are taking chance. The airlines etc will still let you board a plane etc to go there, and Canadian Govt is bound to let you in, but then you will have to fight a case against the cancellation of PR order and its a mess.
I would say decide one way or the other. I know its easie said than done.
If you are in EB3, than unless new laws are passed or something changes, you could go to Canada, live there 3 yrs, get Canadian citizenship and your PD will still be waiting for you at May 1st when you come back.

I have a few questions about what happens AFTER the I-485 is successfully filed?
How long before you get the notice to appear for finger printing?
How much time between getting the notice for Finger printing and the actual appointment?
When does the EAD come through and is there a way to expedite the EAD process?
When does the process go to the "name check" black hole and you informed about it?
Any other info by the experienced gurus will be appreciated

With GC process bound to take long, staying at the same place to avoid changing address may be a big challenge.
Has anybody considered using PO box for address on I-485? My lawyer did not allow me to use PO box during July 2 filing.
Will it be possible to go online and change to PO box address for I-485?
Does INS has any issues in sending GC to po box address?

your employer has to update your I-9 form with the EAD documentation, you need AP for travel only, you will not be deported if you change to EAD.

At last my labor is approved and I was to planning to file my 140 under PP. How ever, I am reconsidering the thought as my wife is on H4 and she is being hired on a H1B from Oct1st. If my 140 is filed under PP and approved, her H1 is approved by June/July Can I transfer my H1 to another company to port my PD? What happens to my wife's H4? I am under the impression that she needs to file an extension as well along with me. This will have her H4 approved after H1 and she will need to re validate her H1 status by going out of the country.
Is it possible that my new employer request my H1 transfer and we chose not to request my wife's extension along with mine if she has 2+ years left from the extension we received based on my previous extension? If we have to file for her extension when I transfer (which I think) PP is of no use as Oct 1st 07 is 6+ months away.

Hello,
I am here on a H1B visa and my wife is on a H4 Visa. She has recently been admitted to a masters program and would start going to school soon.
1. We want to get a F1 visa for her, so that she can get paid for some work in the campus. Would it be possible to get the F1 visa in Canada. Does anyone have any recent experience on getting this done ?
2. Say we not apply for a visa but only apply for a change of status and do not even go to India or anywhere else before the completion of her program. After that she would go on an OPT. If we go to India then, would it not be a problem in getting a F-1 visa, as her education would already be complete. Does it mean that she should get her visa stamped before she completes her education.

Answer: Yes, as long as the requirements are met. First, the key is whether the employment is in a "same or similar" occupational classification as the job for which the original I-140 petition was filed. Second, it may be appropriate to confirm that the new employer and the job offer are legitimate through an RFE to the adjustment applicant for relevant information about these issues. Third, as with any portability case, USCIS will focus on whether the I-140 petition represented the truly intended employment at the time of the filing of both the I-140 and the I-485. This means that, as of the time of the filing of the I-140 and at the time of filing the I-485 if not filed concurrently, the I-140 petitioner must have had the intent to employ the beneficiary, and the alien must have intended to undertake the employment, upon adjustment. Adjudicators should not presume absence of such intent and may take the I-140 and supporting documents themselves as prima facie evidence of such intent, but in appropriate cases additional evidence or investigation may be appropriate.

I tried it. They might wont ask new approval notice. You should show that and get the expiry date in I-94 as same as your latest I-797 Approval notice.
You don't need to stamp visa as its not expired.....

May be IV code is already aware and working on this. I think with the nuke deal out of the way, we now have a window of opportunity - may be Q1/Q2 2007 - during which we can try to get USINPAC, India caucus etc. to listen to us and hopefully actually do something.
Once the so called "123 agreement" is finalized and reaches congress for approval, we would again be shut out of any help from USINPAC and others.

There are very few private loan options that you have. If you have a co-signer who is permanent resident or a US Citizen, you have a bigger pool of options but I know of one organization "Access Group" who give out loan if your stay in US is more than 3 yrs + if you have 4 credit cards in your name..You can dig into more details by googling them.
Most of the schools in US also have a tie up with TMS (tuition management system) which let you pay your semester fees in monthly installments. You might want to check that out too. Hope this helps. Good Luck!

Hi Guys
I am about to file the 485/EAD/AP based on EB2 PD May 2003.
My lawyer says that after July 30th 2007, if we are filing EAD & AP along with 485, then we do NOT need to include the fees of EAD and AP. The total fee in such a case is 1010$.(485 + Biometric = 930+80 = 1010$)
Is this correct that if EAD/AP are applied with 485 after July 30th 2007, then there is no special fee for EAD/AP

we are take a cruise to Alaska this summer, on our way back the ship docks in Victoria, British Columbia for a day.
I am currently on AP, which I plan to use for re-entry into the US. Haven't renewed my H1 visa.
I understand that I need to apply for a Canadian Visitor's Visa.
there are a list of documents that I need to send to the consulate, including my passport and US Visa documents (ofcourse). Since my H1 visa is no longer valid, I was wondering if I need to send my AP document (or would a copy be sufficient)?? Do i need to prepare a separate application with supporting documents for my wife, or can I just include her in my application?
All this seems like to much of a hassle :mad:, considering that it's just a few hours in Canada itself, not to mention it's going to put me back by a couple of hundred $$ atleast.

Once a person had applied for 485, till they get advance parole if they had gone out of US, the application will be dropped.
I did hear that if you are in H1 B then it is not the case, but lots of Lawyers are advising not to get out of country till the person gets advance parole.
I do remember seeing lots of discussion in one of the portals on this topic, I remember that counselor processing is the option in this type of case.
This is a complex situation, you should consult a lawyer.

your wife is fine, with H1 transfer there is no need to file H4 transfer. She is not out of status.
If she had presented the new H1 approval she would have got I-94 based on that date. So just apply for her H4 extension now.
And no issues with filing I-485

u can file but u have to join the petition filing employer once u get GC or otherwise it will be fraud.
